As a reseller we too can have a TOS with our clients. However, since our Terms will basically be our clients terms...is it ok to copy and modify the HG TOS for our use? What of the Privacy Policy?

You can use our ToS as long as you change anywhere it says HostGator to your company name. Basically since we umbrella you if you're on one of our servers you can leave out certain things that your clients might not need to know, but they will still be in effect on our side.
Please let me know if there's anything I can clarify for you further. Thanks!

Does the dedicated server have the TOS applied?

Not the resource usage part as of shared plans.
Certain activities not allowed on shared are allowed on Dedi's. But the purpose of use should be Legal and that fits industry standards, these are normal findings, you can email sales or ask live chat for official answers though. |

It includes several sections that explicitly apply to all accounts, and part of it applies explicity to dedicated server accounts.
The best thing is to read it, then ask for specific clarification if you need it: Terms of Service
