Default So from what I understand emulators are allowed

So at what point does hostgator draw the line? Inevitably, talk about emulation leads to possible hosting of emulation programs. That in turn most definitely triggers talks about roms & the same scenario of hosting them as above.

Seeing as nintendo, sony & microsoft (plus sega) have sued some emulation hardware companies (the R4 card for the nintendo handheld for example - http://www.bit-tech.net/news/gaming/...t-against-r4/1).... where exactly does hostgator draw the line for emulation sites?

My guess would be that it's OK until HG receives a subpoena along with the one you're getting.

lol true, I do know that a site I once affiliated with (xtemulation) is focused on emulation discussion and I think they even host some emulation programs as well. But before I start and if I start I'd like some solid info if any to go on.

We're fine with the content until the content becomes a breach of copyright and thus, US law.

This means no ROMs can be hosted on your site, and no linking to ROM download sites. You can discuss them on your site, however.

Emulators and emulation is a broad topic.

Various portions of the emulation scene, such as home-brew software are perfectly legal and acceptable to host with us. Others, such as the sharing of copyrighted ROM/BIOS/CD/DVD images are strictly illegal, and we would not be able to allow be hosted.

The sale of devices that break copy protection, such as the R4, even if used for legitimate means is illegal (under the DMCA anti-circumvention provisions). We would not be able to allow sites selling these devices to be hosted either.

A simple discussion forum should not present any problem as long as copyrighted material is not linked to nor hosted.
