After reading the ToS I came across this

No, it is possible to use scripts such as Gallery2 or Coppermine that allow uploading images and displaying them.

And jclar, note the difference between displaying them in the gallery, which is OK, and allowing them to be hotlinked for use on other sites, which can chew up CPU and would be against the spirit of the TOS.
